"THE COOKIE CRUMBLES"
CONTEST OFFICIAL RULES

  1. THE COOKIE CRUMBLES CONTEST (the "CONTEST")
  2. The Contest is sponsored by StopBadware.org and the Berkman Center for Internet and Society (collectively the "Administrators"). The Contest begins at 12:01 AM PST on October 5, 2007, and ends at 11:59 PM PST on October 21, 2007 (the "Contest Period"). No purchase or payment is necessary to enter or win; participation in the Contest is free. All federal, state, local and municipal laws and regulations apply. Void where prohibited.

  3. ELIGIBILITY
    The Contest is open to legal residents of the fifty (50) United States and the District of Columbia eighteen (18) years of age or older who maintain a valid user account with YouTube Inc. ("YouTube") during the Contest Period. Employees of, agents of, and individuals affiliated with the Administrators, and their respective parents, subsidiaries, affiliates, advertising and promotion agencies and immediate family members and/or those living in the same household with any of the foregoing are not eligible to enter the Contest.

  4. HOW TO ENTER
    To be entered, a video (1) must not be larger than one hundred megabytes (100 MB) (the maximum file size for any video uploaded to YouTube); (2) may not exceed two (2) minutes in duration; (3) must be provided in a standard format accepted by YouTube; (4) must be primarily in the English language or subtitled or dubbed in the English language; and (5) will be subject to the YouTube Terms of Use, located at http://www.youtube.com/t/terms.

    To enter you must complete the following steps:

    1. If you are not an existing YouTube member, log onto http://www.youtube.com and create a YouTube account (In order to complete step 2 you must have a YouTube account and username). If you already have a YouTube account, go to step 2;
    2. Go to http://cyber.law.harvard.edu/cookiecontest/form.html (the "Website") and complete and submit a Contest Entry Form (the "Entry Form"). You must submit an Entry Form before your video can be accepted into the Contest;
    3. Log onto http://www.youtube.com/group/cookiecrumble and join the group (the "CookieCrumble Group") during the Contest Period; and
    4. Upload the video identified on the Entry Form to the CookieCrumble Group (the "Entry") during the Contest Period. Entrants should make sure to use the same username and title that they provided on the Entry Form. This is a moderated group; Entries will not appear until reviewed and approved by the Administrators.

    Once an Entry form has been submitted and an Entry video had been uploaded, the Entry is final and may not be modified or edited. No Entries will be returned and no acknowledgment of receipt will be provided. Entries that do not adhere to these Official Rules will be considered void and disqualified from the Contest at the sole discretion of the Administrators. By entering the Contest, Entrant represents that the Entry is his or her solely owned work and that Entrant has all applicable rights and permissions to the Entry.

  5. LICENSING OF ENTRIES
    By submitting an Entry Form and uploading an Entry, each Entrant licenses the Entry under the Creative Commons Attribution-Noncommercial-Share Alike License, available at: http://creativecommons.org/licenses/by-nc-sa/2.5/.

  6. GENERAL RULES GOVERNING PARTICIPATION:
    Entries that contain inappropriate content, as determined by the Administrators in their sole discretion, will be disqualified, including, without limitation, Entries that contain vulgarity, obscenity, lewd, pornographic, or violent material, and material that promotes violence. Entries that contain commercial content that promotes any commercial product, service, or entity will be disqualified at the sole discretion of the Administrators.

    The Administrators reserve the right to disqualify any Entry for any reason. The Administrators further reserve the right to remove any entries from the YouTube Group for any reason.

    By submitting an Entry Form and uploading an Entry, each Entrant gives permission to the Administrators to use all information provided by the Entrant on the Entry Form, including but not limited to his or her YouTube username, real name, location, phone number, mailing address, likeness, and/or statements regarding the Entrant's participation in this Contest for any purpose reasonably related to the Contest.

    By participating in the Contest, Entrants accept and agree to be bound by these Official Rules, including but not limited to the eligibility and entrance requirements set forth above. Failure to comply with any aspect of these Official Rules will result in disqualification from the Contest. Entries that do not comply with the requirements set forth in these Official Rules will not be accepted and/or will result in disqualification, in the Administrators' sole discretion. Entrants are subject to the YouTube Terms of Use, located at http://www.youtube.com/t/terms, Violations of YouTube's policies shall result in disqualification at the sole discretion of the Administrators. The Administrators are not responsible for: (i) lost, late, misdirected, damaged, or illegible Entries; (ii) any error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware, or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by the Administrators on account of technical problems or traffic congestion on the Internet, the Website, or any other website or any combination thereof; or (iii) any injury or damage to any Entrant's or any other person's computer related to or resulting from participation in the Contest.

    The Administrators reserve the right, in their sole discretion, to: (i) permanently disqualify from the Contest any person they believe has violated these Official Rules in any way or tampered with or abused the Contest entry process; and (ii) suspend, cancel, terminate or otherwise modify the Contest in any way for any reason.

  7. HOW PRIZES ARE AWARDED
    The Administrators will designate a panel of judges to select, at their sole discretion, five (5) winning Entries (the "Winning Entries") based on the following criteria: creativity and originality, content, persuasiveness, popularity and user ratings. The judging panel's and Administrators' selection of Winning Entries is final, binding and non-appealable.

    Entrants who submit a Winning Entry ("Winning Entrants") agree to accept their prizes as set forth in Section 9. If they do not accept their prizes, winning Entrants shall be disqualified at the sole discretion of the Administrators.

  8. PRIZES:
    Grand Prize: One grand prize of $5,000 will be awarded to the best of the winning Entries, as selected by the judging panel.

    Conference Prize: The five (5) Winning Entrants will be provided with transportation and accommodations to participate in the United States Federal Trade Commission's November 1-2 Town Hall workshop in Washington, D.C. entitled "Ehavioral Advertising: Tracking, Targeting, and Technology."

    The Administrators will determine airline, flight itinerary and accommodations in their sole discretion. Travel must occur between October 31, 2007 and November 3, 2007. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel is subject to the terms and conditions set forth in these Official Rules, and those set forth by the Administrators' airline carrier of choice as detailed in the passenger ticket contract. All expenses and incidental travel costs not expressly stated in the travel and accommodation description above, including but not limited to, additional ground transportation, incidentals, passenger tariffs or duties, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of winner. Travel restrictions, conditions and limitations may apply. If in the sole judgment of the Administrators air travel is not required due to winner's proximity to conference location, ground transportation will be substituted for roundtrip air travel.

    The Administrators shall have no tax liability or obligation with respect to any prizes awarded. Nothing in these Official Rules shall constitute tax advice.

    Winning Entrants may not exchange prizes for any other consideration or transfer, assign, or substitute a prize. No cash equivalent will be made available on prizes. If the United States Federal Trade Commission's November 1-2 Town Hall workshop in Washington, D.C. entitled "Ehavioral Advertising: Tracking, Targeting, and Technology" is cancelled or rescheduled, the Administrators reserve the right to substitute a prize, in their sole discretion.

  9. WINNER NOTIFICATION
    Winning Entrants will be notified via e-mail (the "Notification") sent to the e-mail address associated with the Entrant's YouTube user account. Entrants will also be notified via public posting on the contest website.

    In the event that any Notification is returned as undeliverable or the Winning Entrant is determined by the Administrators not to be eligible for the Contest, the judging panel may select an alternate winning Entry and notify the Winning Entrant. The Administrators reserve the right to modify these notification procedures as may be necessary or advisable in its sole discretion.

    Winning Entrants will be notified by October 23, 2007. A list of the Winning Entries will be available on the contest website beginning on Monday, November 5, 2007.

  10. OBLIGATIONS OF CONTEST WINNERS
    In order to claim a prize, Winning Entrants will be required to execute the following documents: (a) an affidavit of eligibility and compliance with these Official Rules; (b) a release of liability; and (c) a publicity release/agreement (collectively, the "Required Documents").

    The publicity release/agreement shall: (i) permit the Administrators to use and publicize the Entrant's winning Entry, name, Likeness, hometown, voice, and biographical information including, but not limited to, on YouTube and all other media (except where prohibited by law) and (ii) specify that such permitted uses by the Administrators may be for any purpose reasonably related to the Contest.

    If the Required Documents are not executed and returned within three (3) days of the date of the Notification, or if the Required Documents mailed to the winning Entrant are returned as undeliverable, the winning Entrant may be disqualified, and another winning Entry may be selected by the Administrators, in their sole discretion.

  11. WAIVER AND RELEASE OF LIABILITY
    BY PARTICIPATING IN THE CONTEST, EACH ENTRANT ACCEPTS ALL RISKS AND CONSEQUENCES OF ENTRY AND PARTICIPATION IN THE CONTEST AND AGREES TO FOREVER DISCHARGE, RELEASE AND HOLD HARMLESS THE ADMINISTRATORS AND THEIR RESPECTIVE OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, REPRESENTATIVES, AGENTS, PARTNERS, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, THE "RELEASED PARTIES") FROM ANY AND ALL CONSEQUENCES, LIABILITIES, LOSSES, DAMAGES (INCLUDING, WITHOUT LIMITATION, CONSEQUENTIAL, PUNITIVE, INCIDENTAL, SPECIAL OR ENHANCED DAMAGES AND THOSE RELATED TO PERSONAL INJURY, DEATH, OR DAMAGE TO PROPERTY) AND COSTS AND EXPENSES, OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING FROM OR RELATED TO THE CONTEST, INCLUDING, WITHOUT LIMITATION, THE ENTRANT'S PARTICIPATION IN THE CONTEST, HIS OR HER ENTRY OR ENTRIES, AND ANY CLAIMS BASED UPON U.S. OR FOREIGN INTELLECTUAL PROPERTY RIGHTS, RIGHTS OF PUBLICITY, AND/OR INVASION OF PRIVACY, EVEN IF ONE OR MORE OF THE RELEASED PARTIES WERE AWARE OF THE POSSIBILITY OF ANY SUCH CONSEQUENCES, LOSSES, OR DAMAGES. EACH ENTRANT FURTHER AGREES TO FOREVER DISCHARGE, RELEASE AND HOLD HARMLESS ALL RELEASED PARTIES FROM ANY AND ALL CLAIMS THAT ANY USE OF AN ENTRY BY OR ON BEHALF OF THE RELEASED PARTIES INFRINGES THE ENTRANT'S RIGHTS WITH REGARD TO ANY ELEMENTS, CHARACTERS, OR IDEAS CONTAINED IN ANY ENTRY.

    EACH ENTRANT FURTHER AGREES THAT THE RELEASED PARTIES SHALL NOT BE LIABLE FOR ANY DAMAGES, LOSSES, COSTS OR EXPENSES, OF ANY KIND, INCLUDING, WITHOUT LIMITATION, CONSEQUENTIAL, PUNITIVE, INCIDENTAL, SPECIAL, OR ENHANCED DAMAGES AND THOSE RELATED TO PERSONAL INJURY, DEATH, OR DAMAGE TO PROPERTY AND COSTS AND EXPENSES, OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING FROM OR RELATED TO: (A) THE CONTEST, THE ENTRANT'S ENTRY AND PARTICIPATION IN THE CONTEST, AND/OR ANY DECISION BY THE ADMINISTRATORS CONCERNING HIS OR HER ENTRY OR ENTRIES; OR (B) CIRCUMSTANCES BEYOND THE REASONABLE CONTROL OF THE RELEASED PARTIES, INCLUDING, WITHOUT LIMITATION, ACTS OF GOD, ACTS OF GOVERNMENT, ACTS OF TERROR, ACTS OF WAR, CIVIL UNREST, LABOR SHORTAGES AND/OR STRIKES, EVEN IF ANY ONE OR MORE OF THE RELEASED PARTIES WERE AWARE OF THE POSSIBILITY OF ANY SUCH EVENTS OCCURRING.
