Dear Dennis,
Peter called last night to report that you had approached Larry Lessig to
act as an intermediary with me about aspects of the Berkowitz story that
relate to you. Peter indicated that you had given no reason for hope or
expectation with respect to Peter's tenure case, but that you might be open
to consider the broader question I have raised: whether the time has come
for Harvard to reconsider its tenure review policy.
I appreciate you making the approach to Larry. I am anxious to talk to you
directly about any errors of fact or meanness of tone you perceive in our
presentations.
I regret that you do not support our contention of unfairness in the
process of Peter's case. Your support, if you were to offer it, need not
compromise your position on the merits of appointing Peter, but would serve
to show that you appreciate and value fair process.
I would greatly value and welcome your support on the broader need for
reform. The credibility of your support for broad reform would be much
enhanced by supporting Peter's case.
