We invite you to participate in Digital Discovery, an online interactive CLE offering sponsored by the Berkman Center for Internet and Society at Harvard Law School. The offering has two purposes: to explore with participants the complexities of discovery in the digital sphere and to experiment with a new form of CLE which utilizes innovative technologies to deepen engagement, yours and mine, with the issues at the core of digital discovery.

Digital Discovery refers to the discovery of digital information – document files, email and data files from servers, desktops, palm pilots and back-up tapes.  The digital revolution has enabled us to communicate in a more sophisticated and more efficient manner.  It has also, largely inadvertently, left behind data trails that more perfectly chronicle what we have thought and done than any other method of preservation/interaction in history.  As we have come to understand, these data trails of digital communication represent a powerful tool of transparency for those interested in exposing wrongdoing – and a dangerous tool of invasion for those interested in protecting privacy. 

Our four-credit online CLE offering will explore the underlying tensions and possibilities of digital discovery by challenging you with a series of questions that embody the most pressing, controversial and interesting issues of digital discovery, and interacting with you in an exploration of them.  Our objective in designing this online program is to make it as interactive and as close to an intense Socratic dialogue between you and me as we possibly can.  

This offering will experiment with the technologies of online education to create an exciting and intellectually challenging CLE experience in the convenience of your office or home.  Thus, we will utilize a variety of interactive online tools to elicit your opinions and introduce you to the ideas of national experts as well as those of your fellow attorney-peers.  We invite you to join us in re-imagining the possibilities of continuing legal education in the context of an explosive new medium.   We believe there is no more fitting topic of learning to inaugurate our experiment than the exploration of Digital Discovery.
