Memorandum of Understanding between SET and Jamaica Department of Corrections

What follows is the Memorandum of Understanding establishing the institutional framework for S=SET CyberSchool. This memorandum was signed in Kingston on March 23, 2006.


AGREEMENT ON THE INFORMATION TECHNOLOGY REHABILITATION PROGRAMME FOR THE ADULT CORRECTIONAL INSTITUTIONS AND THEIR SURROUNDING COMMUNITIES IN JAMAICA


Whereas the Government of Jamaica is desirous of expanding rehabilitation programmes of the Department of Correctional Services, hereinafter “DCS”;

And

Whereas SET Foundation Limited, hereinafter referred to as SET LTD. is desirous of expanding its program of restorative justice in conjunction with the DCS and institutions of Jamaica by means of establishing a philosophy of self respect and hard work and projecting this message by developing a cyber school for the benefit of inmates, staff, families, citizens and communities of Jamaica

And

Whereas SET Ltd. has been collaborating with the Ministry responsible for National Security through the DCS in the establishment and development of information technology rehabilitation programme, including a cyber school;

The Ministry of National Security on behalf of the Government of Jamaica for the DCS, hereinafter referred to as “the Government” and SET Ltd.,

Have agreed as follows:


Article I

Objective

The purpose of this Agreement is to establish and develop S=SET Cyber school, hereinafter “S=SET, for the benefit of inmates, staff, families, citizens and communities served by DCS


Article II

Responsible Authorities

1. The Government will implement this Agreement through the DCS.
2. The Responsible Authority in the DCS for the overall management and coordination of activities set forth in this Agreement shall be the Director of Rehabilitation.
3. The Responsible Authority in SET Ltd. shall be the Managing Director of SET Ltd. He shall be the Director of S=SET and his duties shall include supervising all S=SET activities; reporting to the Board of Trustees of S=SET and executing the decisions of the Board of Trustees.


Article III

Board of Trustees

1. A Board of Trustees of S=SET is hereby established to oversee the administration and distribution of all proceeds derived from S=SET classes, products and fund-raising activities.
2. The Board shall be comprised as follows:
a. Permanent Secretary, Ministry of National Security or his designee;
b. Professor Charles Nesson, Berkman Centre for Internet and Society, Harvard Law School.
c. Commissioner of Corrections or his designee
d. Designee of SET Ltd. (other than the Managing Director)


Article IV

Joint Team

1. A Joint Team is hereby established to review and evaluate all projects/programmes of S=SET.
2. The Joint Team will be comprised of a designee of the Commissioner of Corrections, three persons nominated by the Commissioner of Corrections and three persons nominated by SET Ltd.
3. The Joint Team will be chaired by the designee of the Commissioner of Corrections.
4. The Joint Team will submit reports of its review and evaluation to the DCS and the Board of trustees of S=SET.


Article V

Roles and responsibilities

Section A DCS Undertakes:
1 To ensure that all activities, publications, productions and products are subject to and consistent with standard operational procedures, the security needs, rules, regulations of the Department of Corrections, the terms of reference for conducting interviews and research and the laws of Jamaica
2 To support the establishment of Information Technology training programmes allowing inmates and staff to learn digital and social and analytical skills including skills of text, audio and video production, communication and marketing
3 To support the establishment of the “Rehab Thru Music” programme as a programme of S=SET
4 To assist in scheduling and facilitating S=SET classes and productions by assigning support staff, chosen by DCS to perform enabling functions, including responsibility for locking and unlocking inmates in keeping with the institution’s regimes
5 To assist by working with SET Ltd. to refurbish, digitally equip and air condition staff rest areas including broadband and internet connections
6 To assist by working with SET Ltd. to install a radio/internet network throughout all DCS institutions
7 To assist by providing appropriate physical space for S=SET classes and related activities
8 To allow SET Ltd. to equip S=SET computer laboratories with its equipment.
9 To provide internal venues for recording, subject to advance approval, for video shoot locations, production times and schedules
10 Subject to the consent of each individual concerned, to allow S=SET to record voice or image of inmates and staff and permit the use of those recordings for media or commercial use for public education, fundraising, and promotion of the programme. Consent to the use of the recordings for media or commercial use shall be subject to censorship of all materials recorded within DCS facilities within a time frame that ensures no holdups.
11 To endorse and participate in projects and fund raising activities of SET Ltd which are for the benefit of S=SET including expositions and concerts within DCS facilities and support for concerts, radio, television and internet programmes related to S=SET.
12 To fill a place on the Board of Trustees of S=SET designated as ex-officio.


Section B SET Foundation Limited undertakes:
1. To develop S=SET by designing, implementing and supervising various corrective, preventive and restorative programmes in conjunction with DCS.
2. To identify and foster talent, promote, produce, co-ordinate and market S=SET events and products.
3. To contract for and otherwise provide logistic support for S=SET activities.
4. To oversee the development of the website for S=SET.
5. To develop and supervise the “Rehab Thru Music” programme as a programme of S=SET in conjunction with other authorized stakeholders
6. To observe all security systems requirements and standard operational procedures of DCS
7. To give a minimum of two weeks notice for all requests for planned activities, especially those activities that require the granting of approval for individuals to enter DCS institutions
8. To report, on a quarterly basis, to the board of Trustees of S=SET, on all financial transactions associated with S=SET
9. To maintain proper accounting records, in accordance with standard accounting principles, on all financial transactions relating to S=SET.
10. To make information on all rehabilitative and preventative activities being supervised by S=SET available to DCS
11. To work with DCS to identify opportunities (programmes/projects, funding sources, etc.) and jointly pursue such projects with DCS
12. To establish co-operative relationship with other support/rehabilitative services and stakeholders.
13. To work with DCS to refurbish, digitally equip and air condition staff rest areas including broadband and internet connections.
14. To work with DCS to install a radio/internet network throughout all DCS institutions.
15. To prepare an Annual Action Plan of Programme Operation and present this to DCS. This plan may be modified as necessary.
16. To serve as a member of the Board of Trustees of S=SET.


Article VI

Conditions of Access

1. SET Foundation Limited representatives will enter DCS institutions under the same terms and conditions applicable to visitors as set out in the Visitor Application Form 2 of DCS except for time limitations
2. Representatives or associates of SET Ltd. who are ex-offenders will not be allowed access to Adult or Juvenile Remand or Correctional Facilities to be engaged in any rehabilitation programme except for the purpose of giving motivational talks to inmates/wards/remandees. Access to DCS facilities by ex-offenders will be subject to approval on a per entry basis.


Article VII

Ownership

1. All equipment and materials procured by DCS shall be owned by DCS notwithstanding that it may be at times managed by SET Ltd.
2. All equipment provided by SET Ltd. will remain the property of SET Ltd and be maintained by S=SET. In relation to any such property SET Ltd indemnifies DCS of any damage or loss to such equipment howsoever caused


Article VIII

Final Provisions

It is mutually understood and agreed by and between both parties that:

Modification:

Any modification within the scope of this Agreement will be made by mutual consent of the parties. This shall be done in writing, signed and dated by both parties.

Participation in sibmilar activities:

This Agreement in no way restricts DCS from participating in similar activities with other public or private agencies, organizations or individuals.

Media Participation:

The parties mutually agree to notify and co-operate with each other in relation to any disclosure in the electronic or print media of activities that constitute the subject of this Agreement.

Termination:

Either of the parties may terminate this MOU in whole or in part at any time subject to notice of this intent being given to the other party one month in advance.
