  • what is the scale of communities that the jury is supposed to represent? are they suppose to represent the norms of their immediate community, or the nation as a whole? it seems that the supreme court was redefining the boundaries of acceptable norms with its jury cases.
  • is the emphasis on the witness being the story teller somewhat disingenuous? is this about maintaining the appearance of pure narrative?
  • was anyone else in Stuntz's crim pro? It seems that he offered a differrent perspective on how the juy right has evolved from Duncan to Blakely, with a strong attachment to the Bill of Rights and not much development on Due Process.
