Is there an estoppel argument here?

IIRC, N2H2 argued that the plaintiff had no standing to bring
the action in the first place because there was no real chance
of his being sued.

Supposing, then, that he does exactly as he describes in
Court.  How does N2H2 pretend surprise, since they in
effect swore that acting in that very fashion wouldn't result
in a lawsuit?
